CONVENTION ON THE RIGHTS OF THE CHILD, UNCRC

The United Nations Convention on the Rights of the Child
Convention on the Rights of the Child
Adopted and opened for signature, ratification and accession by General Assembly
Resolution 44/25 of 20 November 1989
entry into force 2 September 1990, in accordance with Article 49

Article 1
For the purposes of the present Convention, a child means every human being below the age of 18 years unless under the law applicable to the child, majority is attained earlier.
Trivino Y Garcia Caramen / Matiyapak Caramen was below the 18 years of age (born on May 12, 2002) in 2018, date of the ABDUCTION by Trivino Luis and his wife Cosima Pino.

Article 2.1
States Parties shall respect and ensure the rights set forth in the present Convention to each child within their jurisdiction without discrimination of any kind, irrespective of the child’s or his or her parent’s or legal guardian’s race, colour, sex, language, religion, political or other opinion, national, ethnic or social origin, property, disability, birth or other status.
Trivino Luis absolutely hates everything Thai and is a member of the Political Party "Vlaams Blok".
"Vlaams Blok was the name of a Belgian far-right and secessionist political party with an anti-immigration platform. Its ideologies embraced Flemish nationalism, calling for the independence of Flanders. Wikipedia"
Nevertheless, he was chosen by the police and the courts as Trivino Y Garcia Caramen / Matiyapak Caramen's guardian.

Article 2.2
States Parties shall take all appropriate measures to ensure that the child is protected against all forms of discrimination or punishment on the basis of the status, activities, expressed opinions, or beliefs of the child’s parents, legal guardians , or family members.
Trivino Luis declared to the Police during the time that I was in the hospital that Trivino Y Garcia Caramen / Matiyapak Caramen was not allowed to read the Bible.
Trivino Y Garcia Caramen / Matiyapak Caramen was born in THAILAND and was according to the Thai culture educated to the BUDDHIST religion.
Besides this, she was attending a CATHOLIC SCHOOL in Thailand (Assumption College) and had access to a Bible when she wanted.

Translation:
I also feel bad that my brother puts pressure on his daughter in all areas.
For example, he does not allow her to read the Bible.

Article 3.1
In all actions concerning children, whether undertaken by public or private social welfare institutions, courts of law, administrative authorities or legislative bodies, the best interests of the child shall be a primary consideration.
Article 3.2
States Parties undertake to ensure the child such protection and care as is necessary for his or her well-being, taking into account the rights and duties of his or her parents, legal guardians, or other individuals legally responsible for him or her, and, to this end, shall take all appropriate legislative and administrative measures.
Article 3.3
States Parties shall ensure that the institutions, services and facilities responsible for the care or protection of children shall conform with the standards established by competent authorities, particularly in the areas of safety, health, in the number and suitability of their staff, as well as competent supervision.
From the beginning, the best interests of the child was not a consideration for all the public and private instances.

1. Trivino Luis throw me out of his house on 19 October 2018 in a very bad condition (read "20181016 escaping hell.html").
Before leaving the hospital, he said "You will never see your daughter back".
A few days later, while I was still in the hospital, I asked my daughter to bring back my belongings at the hospital.
But instead of my daughter, my brother showed up in an angry mode and aswerred the question "Where is my daughter?" with a grimace. I filed a complaint with the Police because Trivino Luis was not allowing my daughter to get out of the car and visit me while I was lying in the hospital.

The answer from the Police officers was to that they decided to leave my daughter with Trivino Luis, her Abductor.
We inform him that Caramen will be with his uncle for the time being as he cannot take care of Caramen.

2. On December 2, 2018, after living 1 month alone in Thailand and trying to get my daughter back, I received following email from Trivino Luis.

From now on you will be banned from our social media.

My daughter, a 16 year old child, was blocked for ALL INCOMMING and OUTGOING communications with THAILAND by Trivino Luis.
Although Trivino Luis had no legal guardianship of my daughter.
I wrote a complaint to the Police and the Public center for youth welfare, but without success.
Nothing was done by the authorities to stop that behavior and isolating my daughter from her family and friends.

3. On my birthday, December 3, my daughter Trivino Y Garcia Caramen wanted to send me her wishes.
But she could not find my name (nickname Gylenthal Georges) on the Internet because Thailand and my name was blocked by a Firewall.
What even worse, her sister in Finland who she trusted, Trivino Y Garcia Tamara, was also blocked.

Luis Trivino even forced my daughter Trivino Y Garcia Caramen to CANCEL ALL HER SOCIAL-MEDIA CHANNELS (YouTube; Discord; Etc.) and thus deleting many years of work of art (drawings and movies).

The blocking of my daughter's friends and family would lead to a suicide attempt on September 13, 2019.
This was predicted by a lot of friends and family.
But was allowed by all the state agencies who were handling this case, also the OCJ.
It should be noted that Trivino Luis own son Kim Trivino commited also suicide.

Translation:

This ended in a suicide attempt of Trivino Y Garcia Caramen / Matiyapak Caramen on Seltember 13, 2019.

Hi Carlos,
You may know that there have been concerns for some time about the reception of Samui in your brother's family, which is why the screening was extended by 6 months some time ago.
In recent months, we were mainly concerned about the emotional and psychological well-being of your daughter and the way in which the candidate foster parents dealt with this.
A psychologist was recently called in.
Today the situation has escalated to such an extent that Samui, who automutated and suffered from suicidal thoughts, has completely collapsed emotionally and was admitted in crisis to the K-service of Asster in Sint-Truiden.
She finds the necessary rest, is well taken care of and can stay there until 19.09.2019.
A return to your brother's family is no longer an issue.
Other solutions will have to be sought.
Samui herself speaks of a living group or room training.
Suggestions from your side are of course always welcome!
Greetings,
Hilde

In a chat with my 1st daughter, Trivino Y Garcia Tamara, about the suicide, Tamara tell how Trivino Y Garcia Caramen was forced to study by Luis Trivino untill she finally knacked and commited suicide.

Tamara Trivino (my 1st daughter):
Don't think we'll ever find out.
I only know of that one meeting in the shopping where I asked how her drawing was going.
And Luis replied that she didn't have time for that
it was daily school and then homework with Mina every day for many hours.
She also rarely played her guitar
but drawing was almost out of the question.
Even Samui said she ran out of time
I don't think she really liked it.

What is kidnapping by a third party?
The abduction of a child by a third party is a crime and constitutes the unlawful removal of a minor from his or her legal parent or guardian .
It involves taking, moving and transferring a minor to another place.
Child Focus reports not only concern kidnappings by a person unknown to the victim, but usually kidnappings by, for example, unrecognized biological parents, parents who have been deprived of their rights or family members without parental authority.

In the law
The crime of kidnapping and concealment of a minor was included in Article 428 of the Criminal Code and is punishable by prison sentences of 5 to 30 years depending on the circumstances of the kidnapping:

Circumstances Length of prison sentence
The child is kidnapped. 5 to 10 years
As a result of the kidnapping, the child suffers from:
an incurable disease;
a permanent physical or psychological disability;
a complete loss of use of an organ or
a severe mutilation.
15 to 20 years
The child dies as a result of the kidnapping or hiding. 20 to 30 years

Article 4
Governments must do all they can to make sure every child can enjoy their rights by creating systems and passing laws that promote and protect children’s rights.
How to create a system that make sure every child can enjoy their rights?

PS.: Only available in Belgium, the country who created Dutroux and many others.

1. Let somebody with a criminal past abduct a child, example Luis Trivino.
When the LEGAL FATHER AND CARETAKER calls the Police corps that his child has been kept prisoner in a car (with prove on the phone), let the Police give the child back to the abductor and act as your nose is bleeding.
2. Next, let the abductor (Trivino Luis) and the victim (Trivino Y Garcia Caramen / Matiyapak Caramen make an interrogation at the Police station.
The interrogation from the abductor is completely based on lies and presumptions (removing a sanity underwear and rub it in the floor in front of everybody) in the case of Trivino Luis and parrotting everything with every sentence starting with "The Family said" in the case of Trivino Y Garcia Caramen /Matiyapak Caramen.
3. Let the "Public Center for Youth Welfare" take away the rights of the LEGAL father (who is fighting for his life at the hospital) and give the child to the abductor (Trivino Luis). 4. Let the abductor (Trivino Luis) CANCEL ALL COMMUNICATION BETWEEN HIS/HER FAMILY, FRIENDS, AND OTHERS.
Again, when the father writes a remark on this, act as if your nose is bleeding.
5. Let the abductor (Trivino Luis) force the child to CANCEL all her Social Media, including many works of Art in Social Media.
6. Force the child to study for several hours after school time and don't allow any free time for sport or hobbies, cracking a childs mind.
7. When that child finally cracks and try to commit suicide by jumping before a moving train, CANCEL ALL her bank accounts and destroy all her/his belongings to show your superiority.

This was written by TRVIVINO Y GARCIA CARAMEN / MATIYAPAK CARAMEN ON SEPTEMBER 16.
The day of the operation and barely 10 days before the hilarious interrogation.

You have to admit that Belgium is right on track for Children rights, NOT.

Trivino Y Garcia Caramen lost all contact with me, her family, her friends and her teachers after I was back to Intensive care on October 1, 2019 (Post-Operative bleeding).
Trivino Y Garcia Caramen was ready to visit me but was ordered by Luis Trivino to stay in the car. I made a complaint to the local police about this, but the local police left Trivino Y Garcia Caramen with Luis Trivino.

Luis Trivino blocked also the communication with her father and everybody else on December 2, 2018. I wrote a complaint to the OCJ, but they did nothing to restore the communication.

The whole time, communication with Trivino Y Garcia Caramen was impossible to myself and everybody she knew on the excuse that “Caramen didn’t want to contact anybody”.
Sending a Christmas gift or a Birthday card to Caramen was impossible. Although the Birthday Card was delivered at the school by my lawyer, the school refused to accept the Birthday Card and denied access to the school by my lawyer.

Best,
The school refuses my visit to hand over the card to Caramen.
They refer me to foster care. I will also contact Mrs. Mortier of Youth Welfare. I will inform you further.
Best regards.

Even at the suicide attempt and after travelling urgently from Thailand to Belgium, I and her friends where denied visit on the excuse that “Caramen didn’t want to contact anybody”.
But on the Court hearing a few days later, Caramen wriggled herself out of the grip of her Foster Caresupervisor, ran to me and clinged herself to me while crying in front of the lawyers and the judges.

Dear P. P.,
I ask you to apologize for what happened today. Samui's decision not to talk to me after 11 months of not wanting to talk to me had become too much for me.
I have sent the email as you requested and am hoping for an answer.

From: Advocaat P. P. To: Trivino Y Garcia A. Date: Thu, Sep 19, 2019, 7:49 PM Subject: Re: Court of Appeals Dear Abelardo, There is no reason you should apologize.
It was a very emotional moment that I deeply understand and learned a lot from.
Your daughter is really trapped in a straitjacket and cannot be herself.
If she could speak freely without pressure and interference we would be in a completely different situation.
I further hope that Mrs. Mortier can speak to you tomorrow. We have certainly done our best and you cannot be blamed.
Best regards.
P. P.

From the suicide attempt of Trivino Y Garcia Caramen on September 12, 2019, until December I would receive 50 EMAILS from my daughter!!!!!
That is an average of 4 emails per week!!!!!!!
Rather strange behavior of someone who "refused" contact from her father.
Off course, the sect "OCJ" and the Cuckoo's nest are honnest and would never lie.

On top of that, my daughter send me a gift on October 27, 2020 with the little bit of money she had.

Article 5
Governments must respect the rights and responsibilities of parents and carers to provide guidance and direction to their child as they grow up, so that they fully enjoy their rights.
This must be done in a way that recognises the child’s increasing capacity to make their own choices.

Hi Carlos,
You may know that there have been concerns for some time about the reception of Samui in your brother's family, which is why the screening was extended by 6 months some time ago.
Greetings,
Hilde

Article 6
Every child has the right to life.
Governments must do all they can to ensure that children survive and develop to their full potential.
Read Article 5.

Article 7
Every child has the right to be registered at birth, to have a name and nationality, and, as far as possible, to know and be cared for by their parents.
The intention of Luis Trivino from the start was to destroy all contact between the parents and friends.
He was supported in his quest by the Judges and the "Public Center for Youth Welfare".

From now on you will be banned from our social media, if you still want to contact us you will have to do it the old way, paper, pen, cover and stamp, make it right and see you never.
Dec 2, 2018, 8:23 PM

Article 8
Governments must respect and protect that right, and prevent the child’s name, nationality or family relationships from being changed unlawfully.
Read Article 5 and Article 7
Read also the Thai Law on this subject.

Article 9
Children must not be separated from their parents against their will unless it is in their best interests for example, if a parent is hurting or neglecting a child. Children whose parents have separated have the right to stay in contact with both parents, unless this could cause them harm.
Trivino Y Garcia Caramen / Matiyapak Caramen was separated from her father while he was lying in the hospital and had no power to defend himself or his child.
It is clear that Trivino Y Garcia Caramen / Matiyapak Caramen was waiting to return to Thailand and finish her studies.

Everything started the day that I had a post-operative bleeding and was transferred back to Intensive Care on October 1, 2018.
Luis Trivino convinced my daughter Caramen to leave her father and go live with him and his wife, aka "The family" on promesses that she would have a bright future.
Luis Trivino even tried to murder me while I was recovering at their house.
Lucky for me, I could escape from his house but he promised: “You will never see your daughter back”.
The Interrogation of Trivino Y Garcia Caramen was completely based on lies, fabricated falsehoods and perroting what she was told by Luis Trivino and Cosima Pino (aka "The Family").

From the Interrogation of Trivino Y Garcia Caramen / Matiyapak Caramen on October 26, 2018.

Interrogator asks to tell about her father's health problems.
Her daddy has one illness, something with a bloodline (bloodline = vein, aorta), he had to have surgery.
He doesn't talk about that much.
However, her dad's family (1) says it's not all that bad.
Her daddy has become a bit dramatic.
(1) The Interrogator refer to “Luis Trivino & Mina Pino” as “the family”.
Strange that the doctors ALL claimed that URGENT SURGERY had to be done.

TRIVINO Y GARCIA Abelardo contacted his brother TRIVINO Luis in August.
TRIVINO Y GARCIA Abelardo has medical problems.
In Thailand they cannot help him.
TRIVINO then had his brother come to Belgium in the hope that they could help him in Belgium.
TRIVINO Y GARCIA Abelardo has heart problems.
He has 5 veins around his heart that need to be replaced.
Doctors do not dare to start with this.
They have a doctor in Genk found which replaced 1 vein.
The rest of the veins still need to be done.
Furthermore, TRIVINO Y GARCIA Abelardo has a shriveled kidney and they are still investigating whether he suffers from Crohn's disease or cancer.
TRIVINO Y GARCIA Abelardo don't take care of himself.
Since last Friday, TRIVINO Y GARCIA Abelardo has been back in the hospital.
His life expectancies do not look positive.
In the story, Luis Trivino repeated many times that "I was dying" and a few moments later "I had NOTHING" in front of my daughter.

Interrogator asks what she meant by “daddy has gone a little crazy™.
Samui says her daddy has gone a little crazy.
Samui says he has gone crazy here in Belgium.

Samui was in the shower and she heard her dad talking loudly.
He started to call.
Samui had to pack quickly and they would leave.
Samui then hurried and bumped into everything.
The family was angry with Dad.

Samui says that her daddy had her come downstairs one morning, saying she had to call an ambulance for him.
The family didn't want to do that.
They told her daddy that he wasn't sick, that he was just pretending to be.

But at the school I was dying and my life expectances didn’t look good.

Dad's family told Samui that he has already been to 6 to 8 doctors but that there is nothing going on.
Dad himself says he is dying.

The family has also said that Dad is not doing what the doctors say.
He needs to exercise more but daddy is lazy.
He just lies on the sofa and Samui has to bring water for his medication.

When dad went to the family toilet, he made the whole toilet dirty.
He wanted to take the kaka with him.

Samui says that at some point a friend of Dad's came and that Dad was very loud crying.
He wanted to get away from his brother's house.
The family called her to go back inside.

Samui says she takes care of her daddy but she isn't forced to do so.
Dad's family says they are still too small to take care of him.

Interrogator asks who that sister is.
Samui says that her father used to have a house and a family in Belgium.
Her uncle told her that she has 2 sisters and that dad left them on the street and took everything.

My ex-wife and my daughter Tamara did send a letter to the court and my lawyer DENYING that allegation.
Do you want to claim that they are both lying?

Dear
I, Heringklee Nadine, can confirm you that Trivino Y Garcia Abelardo was never violent.
And certainly wouldn't have put our Kids & Nadine out on the street.
I left there myself.
But that abuse is not true.
Not you and not me
Where they get that from is out of the blue.
Ps.: by the way
The only thing I remember is that Luis, your brother, had loose hands
And Anita, his ex-wife, had a lot of rags and he was a tyrant
You can ask Anita about this
greetings
Kind regards
Heringklee Nadine .

Interrogator asks how she sees the future now that she wants to stay here and her father wants to return to Thailand.
She says she has thought about it a lot.
She is worried about her daddy but the family says that daddy can take care of himself.

Governments must do everything they can to stop children being taken out of their own country illegally by their parents or other relatives, or being prevented from returning home.
The will of Trivino Y Garcia Caramen was to return WITH HER LEGAL FATHER BACK TO THAILAND, HER HOME.
It was AFTER she was told stories about her father being crazy and that she was illegal in the country and would be locked up in jail that she changed her story.
The REAL FATHER of Trivino Y Garcia Caramen / Matiyapak Caramen was at that time in the hospital fighting for his life and didn't know what was going on behind his back.

From the phone conversation between Luis Trivino and his daughter Inge Trivino on October 17, 2018 IN FRONT OF MY DAUGHTER:

That's just crazy.
Samui is here without a passport.
- How did Samui entered Belgium without a Passport?
You know that she is illegal.
No, the Belgian not and the passport has not been validated.
- Caramen her passport (which she doesn’t have) has not been validated?
He lost all papers in Thailand.
He has forgotten all of samui's papers in Thailand.
- Except that ALL of Caramen’s papers where in her file which I showed at the City Hall.
So they did not end up in Belgium.
So she's illegal here.
That will even take an official source.
I arranged everything with the school.
The school understands and I got a document from the social services here and that is okay,
But she is not allowed to leave the territory.
Yes, they lock her up.
And then it's on the 1st plane
